Today, my fellow patriots, the South Plains Advocates for Freedom (SPAFF), celebrated the Fourth of July together at the Fourth of July parade on Broadway in Lubbock, TX. What a day to celebrate our freedom, our independence, and our liberty from a tyrannical government, right? We were distributing a single piece of paper (flyer) printed on both sides entitled, Patriot Press, to all of the people who were patiently waiting for the parade to start. This flyer was designed to point out the truth about issues that we feel will limit or restrict freedoms, independence, and liberty of the citizens of Lubbock. We thought we were exercising our First Amendment right to free speech and freedom of the press. If our citizens are burdened with heavy taxes, hidden utiltiy fees, and debt, that takes away some of our freedom and liberty to spend our own money as we choose.
I kindly handed a flyer to an officer Smith who stopped me about twenty seconds later saying, “You cannot distribute these flyers!” I said, “why” and he said that I needed to have a permit. I said, “I kindly disagree with you, sir,” and went on. He stopped me again and said, “You cannot distribute these flyers without a permit” to which I replied, “you cannot permit my Constitutional, unalienable rights that I am entitled to.” He said that within the permitted or barricaded zone, you cannot solicit. Well, soliciting I was not. Maybe they need to understand what soliciting means. I was not offering a good or service. I was simply offering our group’s position on certain city issues. We feel that the truth is not getting out in traditional media, so a few times a year, we ARE the press! I asked the officer if he was going to ticket me or arrest me, and he said, “we will see.” I asked him what he was waiting for, and found that he was waiting for Lieutenant Mendoza to reach me to explain the situation. I showed the Lt. my flyer and he said that I did not have a permit. I kindly said that it was my constitutional right to be there especially given that it was on a public sidewalk paid for by in part by my taxes. He explained to me that you cannot pass anything out between two certain streets. I said you cannot declare this a constitutional free zone, and he said that the Broadway Festival, Inc. organization could determine what goes on within that zone for a certain time period. It should be noted that there were no signs or notifications that free speech was prohibited in this designated zone. The original officer said that I was breaking a city ordinance as well which he didn’t cite, and I said that the city cannot have an unconstitutional ordinance.
They just don’t get it. The very people that take an oath to uphold the constitution don’t even understand the unalienable rights that we are born with granted to us by God Almighty, not to mention the most fundamental rights on this very day, the Fourth of July when “We hold these truths to be self-evident, that all men are created equal, that they are endowed by their Creator with certain unalienable rights, that among these are life, liberty and the pursuit of happiness. That to secure these rights, governments are instituted among men, deriving their just powers from the consent of the governed. That whenever any form of government becomes destructive to these ends, it is the right of the people to alter or to abolish it, and to institute new government, laying its foundation on such principles and organizing its powers in such form, as to them shall seem most likely to effect their safety and happiness.”
It is my hope that some good can come out of this. Am I outraged? Yes, I am! What am I asking of the officers of Lubbock, Texas? I want an apology…not an apology for me, BUT an apology to every red-blooded American who stands up to tell the truth and exercises their right to free speech and press! I also am asking the police chief to immediately put the entire force through a constitutional training so that this does not happen again! I will pay for a Constitutional Attorney and scholar to come do a training for these young men and women. I think that this needs to be a lesson to EVERYONE that we cannot take our freedoms for granted. We must know our rights and express them. We must insist more from the people who serve us! I am asking the city council to review what has taken place and take action immediately. This cannot happen again. In fact, a church group who had passed out religious literature for ten years at the parade and never questioned before was told by Officer Mendoza that they would be required to have a permit as well. Some members of our own group have been passing out patriot literature at this parade for five years or longer and have never been questioned about this practice. Where is our country going? We must stand up. We must stand together in solidarity for truth and justice for ALL, not just a select few, and not just for the elites, but for ALL Americans no matter the political affiliation!

A side note: A woman heard what had just happened and saw how despondent I was and she said hand me a stack of those and I will go to jail with you!
